• Data Loss: In case of suspension or termination, the Company is not liable for any data loss. It is the Customer’s responsibility to maintain backups of their data.

• Downtime: The Company strives to provide a 99.9% uptime guarantee. However, scheduled maintenance, hardware failures, or unforeseen circumstances may lead to temporary downtime. The Company is not liable for any damages or losses resulting from such downtime.
• Technical Support: Technical support is provided via our support portal or email. While we aim to resolve issues promptly, the Company does not guarantee specific response times.
• Server Resources: The Customer is allocated a specific amount of server resources. Overuse or abuse of these resources may result in additional charges or suspension of services.

• Customer Responsibility: The Customer is responsible for maintaining the security of their account credentials, including but not limited to passwords, API keys, and SSH access.
• Security Breaches: The Company takes reasonable measures to protect its servers and network. However, the Customer acknowledges that no system is completely secure. In the event of a security breach affecting the Customer’s data, the Company will notify the Customer promptly and take appropriate remedial actions.
• Data Privacy: The Company complies with applicable data protection laws in India. The Customer consents to the processing of their personal data as described in our Privacy Policy.

• Prohibited Activities: The Customer agrees not to engage in any activities that are unlawful, harmful, or violate the rights of others. This includes, but is not limited to, spamming, distributing malware, hacking, or hosting illegal content.
• Monitoring: The Company reserves the right to monitor the Customer’s use of its services to ensure compliance with these Terms.

• No Warranties: The Company provides its services on an “as is” and “as available” basis without any warranties of any kind, either express or implied.
• Limitation of Damages: To the maximum extent permitted by law, the Company is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of its services.

The Customer agrees to indemnify, defend, and hold harmless the Company from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with their use of the services.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Kerala, India.

The Company reserves the right to modify these Terms at any time. The Customer will be notified of any changes via email or a notice on our website. Continued use of the services after any such changes constitutes acceptance of the new Terms.
